"DOLLY Christmas Wishlist 2011" Promotion

CONDITIONS OF ENTRY

  1. Instructions on how to enter and prizes forms part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.

 

  1. The promotion is open to all residents of Australia except employees of the Promoter, and members of their immediate families and agencies associated with this promotion. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion.

 

  1. The promotion commences on 9th November 2011 and closes at 11:59pm AEDST on 6th December 2011.    

 

  1. The Promoter's decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into.

 

  1. Multiple entries permitted, provided each entry must be submitted separately and in accordance with entry requirements.

 

  1. Incomplete, illegible and incomprehensible entries will be deemed invalid. Any photo that is partially incomplete or obscured or that does not show the whole promotional page may be deemed invalid at the discretion of the Promoter.

 

  1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age, place of residence and/or, if necessary, relevant phone bills to determine identification) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS/MMS costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

  1. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

 

  1. To be eligible to enter, individuals must purchase the December Issue of Dolly Magazine on sale from 9th November 2011. Individuals (excluding VIC residents) must then take a photo of the whole Wishlist advertorial page relating to the prize they wish to have a chance to win, within the December issue with their mobile phone, create a MMS using that photo and send the MMS entry to 0409 343 434, so that it is received during the promotional period, in order to receive a unique code on their mobile phone.

 

Alternatively, individuals who cannot send MMS messages from their mobile phone (and all VIC residents) can send a SMS with the keyword:

GLEE; or 
FUJI;                        

                              

representing the prize they wish to have a chance to win to 0409343434, during the promotional period, in order to receive a unique code on their mobile phone. 

 

  1. The MMS entry mechanism is only open to consumers with an MMS compatible mobile phone connected to a service provider which permits picture messaging to the promotional numbers.  It is recommended that entrants check with their individual service provider before entering via MMS. Entrants under the age of 18 years old must obtain account holder's consent prior to sending a SMS/MMS. This is not a premium rated service and standard SMS messaging and data rates apply for SMS messaging. Entry costs will vary depending on the mobile network used.  The cost of SMS messages will not exceed 55 cents each.  Standard MMS rates apply. Entries are deemed to be received at the time of receipt by the Promoters and NOT at the time of transmission by the entrant.

 

  1. Once the entrant has received the unique code on their mobile phone, to enter, they must then visit www.myxmaswishlist.com.au, follow the prompts to the promotion entry page, input the requested details including their full name, age, address and the unique code received from the Promoter via their mobile phone, and submit the fully completed online entry form by 11:59pm AEDST on 6th December 2011.

 

  1. Upon successful submission of the online entry form, each entrant will be notified instantly in writing online as to whether or not they are an instant winner. All valid entries received from winners and non-winners of an instant win prize will automatically be placed in the unclaimed prize draw for any unclaimed prizes.

 

  1. Victorian residents are not permitted to enter via MMS.  All Victorian entries must be submitted via SMS. Any entry received from a Victorian resident via MMS will not be accepted.

  1. Total prize pool is valued at $2,989.00.

 

  1. Any ancillary costs associated with redeeming a Target Gift Card are not included. Any unused balance of a Target Gift Card will not be awarded as cash. Redemption of the Target Gift Card is subject to any terms and conditions of the issuer including those specified on the Target Gift Card.

 

  1. The Promoter may conduct an unclaimed prize draw at ACP Magazines Ltd, 54 Park Street, Sydney NSW 2000, if necessary, at 10am AEDST on 7th March 2012 in order to distribute any prizes that remain unclaimed by that date and time. This draw will be conducted subject to directions from a relevant state and territory authority. The unclaimed prize draw winner(s) will be notified by phone and then mail using contact details provided in their entry and at the time of winner notification.

 

  1. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited and will not be redeemable for cash.

 

  1. Prizes are not transferable or exchangeable and cannot be taken as cash.

 

  1. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

 

  1. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion (subject to all relevant state and territory regulations) to modify, suspend, terminate or cease the promotion with fair notification to the entrants. The form of such notification is at the complete discretion of the Promoter.

 

  1. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

 

  1. Quality control errors will not invalidate an otherwise valid prize claim.

 

  1. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw.

 

  1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion

 

  1. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; (f) use of a prize; and/or (g) participation in the promotion.

 

  1. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

 

  1. As a condition of accepting a prize, a winner (or their parent/guardian if a winner is under the age of 18 years) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

 

  1. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant.  

 

  1. By entering the promotion, the entrant consents to the Promoter collecting personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages, telephoning the entrant regarding the promotion, and other messages which inform the entrant of the Promoter's other publications, products, services and events and to promote third party goods and services they may be interested in. Entrants should direct any request to access, update or correct information to the Promoter.
